Refund Policy

Introduction

This Refund and Cancellation Policy sets forth the terms and conditions relating to the cancellation of services and refunds for all services offered by Floripi.com.

By contracting any service, the Client declares that they have read, understood, and fully accepted this Policy.

PART 1: WEBSITE PLANS (SaaS-WaaS)

1.1. Scope of Policy for Website Plans

This refund policy applies to all website creation and management services offered by Floripi.com in the SaaS model, including:

  • Personal Website (Basic)

  • MEI Partner Plan

  • Business Website (Pro)

  • E-commerce (Startup, Micro, Prime)

All these plans operate on an annual subscription model with monthly payment, according to Floripi.com's subscription contract.

1.2. How the Annual Subscription Model Works

Subscription System:

  • You contract an ANNUAL plan (12-month commitment)

  • But pay MONTHLY (facilitated)

  • In exchange, you receive up to 50% discount on the monthly amount

Practical Example:

  • Actual monthly amount (without commitment): according to current rate table

  • Promotional monthly amount (with annual commitment): discounted amount

  • You save money in exchange for a 12-month permanence commitment

Permanence Commitment:

  • By subscribing, you commit to maintaining the plan for 12 months

  • The 12 monthly payments are mandatory

  • Similar to a cell phone or internet plan

1.3. Warranty Period - up to 30 Days

The client has up to 30 (thirty) calendar days from the subscription activation date and first website publication to test the service.

Within this period, if not satisfied, the client may request:

  • Subscription cancellation; and

  • Full refund of the amount paid to date

No penalty or additional fee will be charged within this 30-day period.

Note: this 30-day warranty is valid for the first plan contract. Renewals and special customizations may have their own conditions approved in a proposal.

1.4. After 30 Days - Cancellation with Recalculation

After the 30-day period:

  • The service is considered used and accepted

  • There is no right to refund of monthly payments already made

  • You can request cancellation, but there will be value recalculation

In case of early cancellation of the annual contract after 30 days:

  • The promotional amount ceases to be applied

  • Amounts are recalculated based on the actual monthly price of the plan

  • The client pays only the difference according to the contractual formula:

Correct Recalculation Formula:

Difference to pay = (Months used × Actual monthly amount) - Amount already paid

Components:

  • Months used = Number of months from activation to cancellation

  • Actual monthly amount = Monthly price without promotional discount

  • Amount already paid = Sum of all monthly payments made to date

There is no:

  • ✗ Additional penalty

  • ✗ Charge for future unused months

  • ✗ Hidden fees or penalties

  • ✓ You only pay back the discount you received

Example 1 - Cancellation after 3 months:

  • Plan: according to price table (actual monthly amount vs promotional amount)

  • Months used: 3

  • Actual amount due = 3 × Actual monthly amount

  • Amount already paid = 3 × Promotional monthly amount

  • Difference to pay = Actual amount due - Amount already paid

Example 2 - Cancellation after 10 months:

  • Plan: according to price table

  • Months used: 10

  • Actual amount due = 10 × Actual monthly amount

  • Amount already paid = 10 × Promotional monthly amount

  • Difference to pay = Actual amount due - Amount already paid

This calculation is fair because:

  • We don't charge for unused months

  • The client pays only the fair price for the period used

  • It's transparent and easy to understand

There is no proportional refund for unused periods within an already billed month.

1.5. Situations in Which There Is No Refund for Website Plans

There will be no refund, total or partial, in the following situations:

  • When the client does not send content, images, or information necessary for website development

  • When the website is used improperly, in disagreement with the Terms of Use, Brazilian legislation, or third-party rights

  • For third-party fees, such as domain registration, email services, external licenses, payment gateways, or external tools contracted on behalf of the client

  • When the service is suspended or terminated due to default, fraud, or contractual breach by the client

PART 2: ONE-TIME AND HOURLY SERVICES

2.1. Scope of Policy

This part of the policy applies to services such as:

  • Video editing and creation

  • Digital marketing campaigns and actions

  • SEO services (by project)

  • Translation, subtitles, and captions

  • One-time development or adjustments

  • Other digital projects approved in specific proposal

2.2. Warranty and Refund - up to 7 Days

The client will have up to 7 (seven) calendar days from delivery of the first complete version to open a formal request, if:

  • The service was not delivered

  • The delivery is clearly outside the approved scope

  • Serious errors are not corrected within a reasonable timeframe after request

In these cases, Floripi.com may, at its sole discretion:

  • Correct or adjust the delivery

  • Redesign part of the work

  • Or refund the client up to the amount actually paid for the service in question, closing the case

2.3. After 7 Days

After the 7-day period:

  • The service is considered accepted

  • There is no right to refund due to change of opinion, strategy change, or subjective dissatisfaction after prolonged use of the material

  • Any additional modifications will be considered a new service, with new budget

2.4. Hourly Services (consulting, IT, SEO by the hour, etc.)

Hours already worked or sessions already completed are not refundable.

"Worked hour" is considered:

  • Any session started

  • Meeting held

  • Documented work executed

Floripi.com maintains records of all hours worked (activity reports, meeting minutes, partial deliveries).

If the client purchases a package of hours in advance:

  • May request refund only for unused hours

  • Deadline: up to 7 calendar days from the first session

  • Documentation: Floripi.com will provide detailed report of hours consumed

If the majority of the service has already been provided:

  • Floripi.com may retain an amount proportional to the work executed

  • Calculation: (Hours worked ÷ Total hours contracted) × Total amount paid

  • Refund only any remaining balance

2.5. Situations of Absolute No Refund

There will be no refund, total or partial, in the following situations:

  • When the client does not provide the complete original text or information necessary to complete the service on time

  • When the client requests modifications beyond the originally agreed scope

  • After use, publication, or commercial exploitation of the material by the client

  • When using the material in violation of intellectual property rights or third-party rights

  • In case of breach of Terms of Use or violation of Brazilian legislation

  • When the client delays in providing necessary feedback or approvals

PART 4: TRANSLATION SERVICES

4.1. Scope of Policy

This policy regulates all individual online classes offered by Floripi.com, including:

  • Individual Classes (On-Demand)

  • Plan by Level (4 months)

By booking any class or plan, the student declares that they have read, understood, and fully accept this policy.

4.2. Cancellation with at Least 24 Hours' Notice (valid for all plans)

The student may cancel or reschedule any class with a minimum of 24 hours' notice.

Cancellations within this timeframe are entitled to:

  • Full refund, OR

  • Full credit to reschedule the class

Requests must be made through official channels.

4.3. Cancellations with Less Than 24 Hours - No Refund

Cancellations made with less than 24 hours are not entitled to refund.

  • The amount is considered used, as the time slot was reserved exclusively for the student

  • The class cannot be rescheduled free of charge

4.4. Student Absence (No-Show)

If the student does not attend the class without prior notice:

  • The class is considered completed

  • There will be no refund or makeup class

4.5. Cancellation by the Teacher

If the teacher needs to cancel, the student may choose between:

  • Reschedule at no cost; OR

  • Receive full refund

4.6. Individual Classes - "Per Class / On-Demand"

  • There is no subscription or continuity commitment

  • The student pays only for the reserved class

  • Only the 24-hour rule applies

  • There is no penalty, cancellation fee, or future obligations

4.7. Plan by Level (4 months)

The Plan by Level functions as a 4-month educational contract.

a) Commitment and Payment

Upon entering the plan, the student agrees that:

  • The total amount for the level is according to the current rate table

  • Payment is monthly (according to signed contract)

  • The commitment is full for 4 months, even if the student decides to interrupt classes

  • Non-payment may generate legal collection of the amount due

b) Cancellation Guarantee - first 30 days

The student may cancel the plan within the first 30 days of the first class.

In this case:

  • All classes in the level will be recalculated at full price (without package discount)

  • Any excess balance will be refunded

Formula: Payment due = (Number of classes completed × Full price per class) - Amount already paid

c) After 30 days - Cancellation with Penalty

After 30 days from the first class:

  • The student may still request cancellation, however:

    • Will not be entitled to refund of amounts already paid

    • Remains responsible for full payment of the plan (4 months)

    • If cancellation is insisted upon, all classes in the level will be recalculated at the full unit price (without package discount)

Calculation of difference due: Difference = (Number of classes in the level × Unit price without discount) - Amount already paid

Early termination penalty:

  • A compensatory penalty of 10% of the total remaining contract amount will be charged

  • This penalty is limited to a maximum of 20% of the total plan amount

Illustrative example:

  • Plan: 4 months / number of classes according to contract

  • Student cancelled after 2 months

  • Recalculation difference + penalty will be calculated according to clauses above

  • Maximum amount due: will not exceed the originally contracted total amount

Legal note: This clause complies with the Consumer Protection Code (CDC) and does not impose excessive burden on the student. The right to cancel is guaranteed by Brazilian legislation (CDC). This clause only establishes the financial conditions of early cancellation.

d) Cancellation of classes within the plan

  • The student may cancel or reschedule any class before 24 hours

  • Missed classes count within the level's classes

4.8. Flexible Good Faith Policy ("Grace")

Floripi.com reserves the right, at its sole discretion, to accept cancellation requests made with less than 24 hours in exceptional cases, as a gesture of good faith.

This does not constitute a rule, does not create future obligation, and does not guarantee acceptance in similar requests.

PART 5: GENERAL PROCEDURES

5.1. Corrections and Adjustments Instead of Refund

Since services are customized, Floripi.com prioritizes:

  • Layout adjustments

  • Technical corrections

  • Content improvements

  • Support and usage guidance

Before considering a refund. The goal is to ensure the client receives maximum value from what was contracted.

5.2. How to Request Refund or Cancellation

Every cancellation request with refund must be made in writing, through the official contact channels available on the Floripi.com website, respecting the deadlines:

  • Up to 30 days for website plans

  • Up to 7 days for one-time or hourly services or translation

  • Up to 24 hours for classes (general rule)

  • Up to 30 days for class plans (cancellation guarantee)

The request must include:

  • Order or project number

  • Detailed description of the problem or reason for dissatisfaction

  • Specific examples of errors, if any

Floripi.com may request additional information to better understand the reason for the request and propose improvements, when applicable.

All requests will be answered within 3 business days.

Once approved, the refund will be processed using, whenever possible, the same payment method used by the client, within 10 business days.

5.3. Recognition of Model and Policy Limits

The client acknowledges that:

  • Floripi.com's services are digital, customized, and provided continuously (in the case of subscriptions)

  • Promotional prices depend on minimum permanence commitment (for website and class plans)

  • Not every subjective dissatisfaction generates automatic right to refund, especially after actual use, disclosure, or economic exploitation of delivered material

  • Starting work on the project means investing non-recoverable time and resources

  • Does not have the right to claim refund after using or exploiting the material/service

5.4. Force Majeure or Fortuitous Event

In exceptional situations outside Floripi.com's control (pandemics, natural disasters, serious technical problems, etc.):

  • Classes/services may be temporarily suspended

  • The plan/contract term will be automatically extended by the suspension period

  • There will be no additional charges or penalties

  • The client will be notified in advance whenever possible

5.5. Dispute Resolution

In case of disagreement about this policy:

  • The client must first contact Floripi.com's support for attempted amicable resolution

  • Floripi.com will respond within 5 business days with resolution proposal

  • If there is no agreement, the parties may resort to consumer protection agencies (Procon)

  • The competent jurisdiction is the district of Florianópolis/SC, as provided in the Terms of Use

5.6. Record and Documentation

  • Floripi.com maintains records of all scheduled, completed, and cancelled services

  • The client may request detailed report at any time

  • In case of dispute, Floripi.com's records will serve as proof, unless proven otherwise

  • Booking and cancellation confirmations are automatically sent by email

5.7. Validity and Interpretation of Policy

  • This policy must be read in conjunction with the Terms of Use, Subscription Policy, and Privacy Policy of Floripi.com

  • Applies always to the maximum extent permitted by Brazilian legislation

  • By contracting any service, the client declares that they have read, understood, and fully accept this Refund and Cancellation Policy

5.8. Changes to this Policy

  • Floripi.com reserves the right to update this Refund Policy at any time

  • Relevant changes will be communicated by email or notice on the website

  • Already executed contracts will remain governed by the version in effect at the time of contracting

  • New contracts will follow the updated version of the policy

Final Recognition and Acceptance

By contracting Floripi.com's services, the client/student acknowledges the following:

  • Read, understood, and fully accepted this Cancellation and Refund Policy

  • Understands that services are digital, customized, and require specialized human effort

  • Understands that starting work on the project means investing non-recoverable time and resources

  • Does not have the right to claim refund after using or exploiting the material/service

  • Any dispute will be resolved according to applicable Brazilian legislation
